The 30-Month Stay Rule: The Condition Attached to a Distance-Won P1 Place

What the rule is for

Distance priority is meant to reflect where a family actually lives, not where it can arrange to appear to live for a few months. The 30-month condition is the enforcement mechanism: it makes a short-term rental or a temporary transfer of address into a commitment measured in years.

When the clock starts

• An address you already occupy: from 30 June 2026 of the registration year.
• A new property: from the date your family moves in.
• A resale property: from the date your family moves in, following the completion of the purchase.

Because the start date shifts with the move-in date, a family that buys late can find the 30 months running well past the child’s Primary 1 year. Work out the end date before you commit, not after.

What MOE can ask for

MOE may require evidence that the condition is being met. If it is not met — or if you cannot evidence it to MOE’s satisfaction — MOE may transfer the child to another school, and MOE states plainly that parents will have no say in which school that is. This is not a fine or a warning; it is a reallocation of the place.

The cases people get wrong

• Renting near a school, then buying elsewhere. The common plan, and the one the rule is built to catch. If the purchase completes inside the 30 months, you have a problem.
• Registering at a relative’s address. Using a caregiver’s or grandparent’s address engages the same condition on that address, with its own start-date rules. Check MOE’s guidance on which address to use before you decide.
• Assuming it only applies if you balloted. The condition attaches to a place obtained through distance priority — not only to one obtained through a ballot you won.

If your circumstances genuinely change

Life happens — an en-bloc, a job posting, a divorce, a lease that ends. Contact MOE and the school rather than simply moving and hoping. The consequence described above applies where the condition is not met and no adequate explanation is provided; MOE is the only party who can tell you how your specific situation is treated.
